Terms of Use

1. The service

Undernote is a location-based social network: you drop notes (text, photos, audio recordings) at a precise GPS point. Each note is associated with an audience of your choice (public, mutuals, designated people, or only you), two distance radii (reading radius and visibility radius) and a lifetime of your choice (ephemeral: 1 day, 1 week or 1 month; or permanent). You can link your notes into narrative threads, relay other users' notes through echoes, and exchange private messages with your mutuals.

These terms apply to any use of the Undernote app and website. By creating an account, you accept them in full. Version of 27 August 2026.

2. Minimum age

You must be at least 16 years old to use Undernote. This single threshold covers the highest digital age of consent applicable in the European Union. By creating an account, you confirm that you meet this condition. If in doubt, ask a person with parental authority for their agreement.

3. Your account

An account is created with an email address and password, via Google (Android and iOS) or via Sign in with Apple (iOS). You are responsible for keeping your credentials confidential and for all activity carried out from your account. Your username is public and unique; it cannot be changed after registration.

4. Your content and licence

You retain ownership of the content you publish on Undernote (text, photos, audio recordings). By publishing it, you grant Undernote a non-exclusive, royalty-free, worldwide licence to host, display, distribute and partially transmit that content, limited to the duration of publication and to the following purposes of the service: displaying your notes to the audiences and within the radii you have chosen; enabling echoes, that is, displaying your note on the profile map of the user who relayed it; enabling your notes to be shared in conversations, with content displayed according to the recipient's access rights at the time of reading; displaying a preview on the discovery surface (teaser) within the limits set by the service; transmitting an excerpt for notification purposes.

This licence ends when the content is deleted, subject to technical purge delays and the cases set out in section 9. You alone are responsible for the content you publish and for the rights you hold over it.

When a user relays your note through an echo, their position at the time of the echo is copied and frozen as the centre of their echo bubble, for the entire lifetime of the carried note. If you disable echoes on a note after publication, existing echoes are permanently deleted. Orphaned media after content deletion are purged in the following weekly cleanup, at most around ten days after deletion.

5. Prohibited behaviour

The following are prohibited on Undernote: publishing illegal, hateful, harassing or deceptive content; impersonating a person; collecting personal data from other users; scraping or any automated collection of the service; using bots, scripts or any automation system; attempting to decompile, reverse-engineer or circumvent the technical measures of the service; reselling or renting access to the service; spoofing your GPS position. Undernote has no tolerance for objectionable content or abusive users: such behaviour leads to content removal and may lead to an account ban. Accounts in violation may be suspended or deleted, in accordance with section 8.

6. Geolocation

The service relies on your location: it is used to display relevant notes around you and to drop your own notes at the precise place you choose. Without location permission, the map cannot function. Your location is never shared directly with other users; it only determines the notes you can see and the location of the notes you drop. 7. Points campaign

Undernote may run campaigns that award points according to an internal scale, deliberately unpublished. Points are neither a currency nor a financial instrument and have no exchange value. They are tied to your account and permanently lost if your account is deleted. A campaign may be suspended or stopped at any time. A banned account no longer takes part in the campaign: no further points are awarded to it. Any fraud (simulated location, coordinated accounts, automation) may result in points being withheld or forfeited, without prejudice to sections 5 and 8. In the event of points being withheld or forfeited, you will be notified with the grounds for the decision.

Points are awarded according to criteria of activity (published contributions, interactions received), network engagement (active referrals) and loyalty (length of participation); the precise scale remains confidential. If our automated system detects potentially fraudulent behaviour, you may contest its findings by email at hello@undernote.app. The history of points awarded is retained for the duration of your account.

In the future, at our sole discretion, we intend to reward the pioneers who join us during the campaign. This commitment expresses an intention, not a contractual promise. It does not constitute an offer of financial securities, a promise of remuneration, or an acquired right. Any terms will be communicated in separate conditions, within the applicable legal framework, in due course.

8. Moderation and reporting

Any logged-in user can report a note, a profile or a message directly from the app. Any person, even without an account, can report illegal content by email at hello@undernote.app.

Possible moderation decisions are: removal of the content, banning of the account, or no further action. Content reported by several users may be hidden automatically, for everyone, pending review by our team; if no decision is taken within fourteen days, it is removed automatically. Content published by a banned account may remain visible until that account is deleted. In the event of content being hidden or removed, or of an account ban, you will be notified by email, with the reasons for the decision. You may contest it by email at hello@undernote.app; every contestation is reviewed by a person. If you reported content, you will be informed by email of the outcome. Banned accounts retain their rights regarding their personal data and may exercise them within one month by writing to hello@undernote.app. To report content by email, please indicate the content concerned (link or description), its location in the app, the reason for the report and your contact details.

Content that constitutes a serious threat to the life or safety of people will be reported to the competent authorities.

9. Account deletion

You can delete your account at any time from Settings, Delete my account. Deletion is permanent: your profile, notes, photos, audio recordings, comments, follows and followers are erased; your conversation messages are permanently erased for all participants. Campaign points are permanently lost (section 7).

Some data may be retained beyond deletion, strictly to the extent required by our legal obligations or for moderation purposes (in particular, copies of reported content). Our privacy policy (undernote.app/en/privacy) specifies the applicable retention periods. Exception: feedback submitted via the "A bug, an idea?" feature generates an email retained in our mailbox until manually deleted; that email is not automatically erased when your account is deleted.

10. Availability and changes to the service

Undernote is provided free of charge, with no guarantee of permanent availability. The service may be modified, extended or reduced at any time. If we decide to shut it down, we will inform you with reasonable notice.

11. Liability

Undernote acts as the host of the content you publish. Its liability in that capacity can only arise from the moment it has actual knowledge that content is manifestly unlawful and has not acted promptly to remove it.

Undernote cannot be held liable for service interruptions resulting from force majeure or the actions of a third party.

These terms cannot exclude or limit the mandatory statutory guarantees to which you are entitled as a consumer, Undernote's liability in the event of personal injury, or its liability in the event of gross negligence or fraud.

12. Changes to these terms

These terms may change. In the event of a substantial modification, you will be informed by an in-app notification with reasonable notice, unless there is an emergency relating to the security of the service or a legal obligation requiring immediate effect; your explicit confirmation in the app will be required before continuing to use the service. The version in force is always identifiable by its date, visible in section 1. If you do not accept the changes, you may delete your account. For minor changes, continued use of the service constitutes acceptance of the terms in force. Minor changes include rewording without substantive change, formal corrections, editorial clarifications, and updates to contact details.

13. Governing law and jurisdiction

These terms are governed by French law. In the event of a dispute, the French courts have jurisdiction. If you reside in the European Union, you retain the protection of the mandatory provisions of your country of residence and may bring proceedings in the courts of that country.

The French version of these terms is the binding one; translations are provided for convenience.
